Terms And Conditions    
     
Contract
These following terms and conditions govern the supply of goods and the services sold by Top Floors (East Anglia) Ltd Unit 7, Sproughton Business Park, Farthing Rd Industrial Estate, Ipswich, Suffolk IP1 5AP.

The following terms and conditions establish the entire and only agreement between us in relation to thereto. Our acceptance of your order by the delivery of the goods or fitting constitutes a legally binding contract between us on these terms and conditions.
 
Price & Payment
The client agrees:

Domestic Flooring Ipswich To pay in full the whole price of the goods you order before the order can be accepted unless we have agreed otherwise in advance.
Ipswich Domestic Flooring To pay any invoice balance within 28 days of the date of invoice, unless we have agreed otherwise in writing.
Domestic Floors Ipswich To pay us such costs and expenses we may incur in recovering payment from you, where you fail to make payment in accordance with these terms and conditions.
Ipswich Domestic Floors Payments can be made, via bank transfer, cash, and cheque or credit/debit card payment.
Home FGlooring Ipswich Payment made by credit card will incur a 2% charge.
Ipswich Home Flooring All retail sales require an immediate payment unless we have agreed otherwise in advance.
Home Flooring Ipswich All overdue accounts will attract a charge of interest at the rate of 8.0% + Bank of England base rate per annum in accordance with the Late Payment Commercial Debts (interest) Act 1998.
 
Client Obligation
We shall perform all duties, services and obligations under this contract with reasonable care, skill and to a reasonable standard. We shall comply with all relevant codes of practice and statutory or regulatory requirements.

We shall take reasonable care with your property, including taking reasonable steps to protect  your furnishings, wall and floor coverings during the provisions of the services but cannot take any responsibility for any damage which is caused.
We shall be responsible for managing and arranging the safe and lawful disposal of any waste material which is generated or removed from the client’s property as a result of the provision of the services.

We shall at all times hold valid employer and public liability insurance policy and shall hold and keep up to date any and all licences or permits as may be required in order to provide services.

We shall ensure all of our fitters have a current CRB check.
 
Suppliers Obligation

Returns
If you have ordered a stock product and the item has been delivered to you, it is your responsibility to pay the cost to the return the item.

Any item specially ordered for you cannot be returned unless faulty.

Any item returned damaged will not be accepted and must be paid for, unless faulty.
 
 
Force Majeure
 
Quotation
All quotations supplied for supply only, for supply and fitting, for fitting only or any renovation services will be valid for a total of 2 weeks after the date of the quotation and subject to reconfirmation by us at the time of your order.
 
Ownership
The ownership of the goods shall not pass to the buyer until the buyer has paid Top Floors (East Anglia) Ltd the whole price thereof and the price of any other outstanding sale.
 
Design & Use of Website
Drawings, photographs, text, layout and style/design are considered property of Top Floors (East Anglia) Ltd. Reproduction in whole or in part are strictly prohibited without written permission. All products are subject to availability. Goods are not sold on any trial basis.
 
Clients Obligation
You shall provide access for works to be completed at the agreed installation date. If we are unable to gain access at the agreed installation date, the client will incur an additional standard no access fee, which will be added to the overall invoice upon completion.

You shall provide details of any under floor pipes, cabling etc. We shall not be liable for any damage caused if this information is not provided in writing before the commencement of works.

Adhere to all terms and conditions.
 
Guarantee
We shall provide a one year guarantee of work. If you report a fitting defect outside of one year since the date of instalment we cannot accept responsibility.
 
Warranty
The warranty will be provided by the manufacturer of the items and products.
 
Cancellations
Cancellations of orders must be received in writing either by, mail, fax or email to info@top-floors.co.uk.

Any cancellation received after acceptance of the quotation are subject to administration charges.

If cancellation is received after the flooring or items have been ordered and delivered to us, a return fee of 30% of the purchase price will be charged.
 
Manufacturing Faults
It is the responsibility of the client to check the product for damage or defects. If damage or defects are discovered either by you or us, it will be discussed with you before installation and if necessary the damaged or defective items will be returned to manufacturer for a replacement.

Top Floors will not accept any claims for damaged or defective items once the flooring has been installed, as once installed it will be taken as conclusive evidence the client has accepted the goods are in an acceptable condition.

We accept no liability for any costs incurred due to delays caused by faulty products.

If you are unfortunate enough for the product to develop a fault after installation arising from manufactures, we will inspect the fault and refer to the manufacturers on your behalf. It may be necessary for the manufacturer to inspect the fault for themselves.
 
General
All carpets, even when cut to room sizes, are heavy and difficult to manoeuvre, especially on premises where the layout and access are restricted. In some premises the carpet may have to be folded to gain access, which may leave slight creases in the pile. We cannot accept responsibility for damage to surface finishes caused by the movement of the carpet in restricted spaces.

We shall program works during normal working hours, 9:00a.m to 17:00pm, Monday to Friday (excluding bank and Public holidays) unless otherwise agreed previously.

Fitting dates will be agreed with you at a suitable time. If the appointment is cancelled less than 48 hrs before fitting a standard administration charge of £30 + VAT will be charged.

Neither party shall be liable for any delay or failure in performing its obligations or duties under this agreement which results from circumstances outside reasonable control including but not limited to acts of God, Industrial action, War, Fire, Threat of Terrorism, Civil Disturbance or rioting, government or regulatory action, breakdown in plant or machinery or shortage of raw materials or supplies.

The website contains material which is owned or licenced by us. This material includes but not limited to, the design, the layout, look, appearance and graphics. Reproduction is prohibited

All areas must be clear of other trades and their equipment so fitting work may proceed with continuity. Where our staff are required to move furniture, electrical equipment/appliances and other objects in the area of installation, the removal is carried out entirely at the risk of the customer. We strongly recommend that the movement of all large items be supervised by you and that fragile or valuable pieces are moved by the client only. We are unable to accept responsibility for damage and/ or breakages caused during the movement of your possessions.

Some of our fitters are self-employed sub-contractors. We shall take responsibility for the work that they undertake under the contract with the client.
We shall take no responsibility to carry out alterations to doors. This responsibility falls to you to ensure sufficient room to fit the new flooring is provided. If any door requires trimming to fit in line with the new flooring, this is your responsibility.

All seam directions, seam positions, weld positions, and pile lay are to be left to Top Floors discretion and unless questioned in writing before estimating will be deemed acceptable with no exceptions.

Value added Tax: VAT will be charged at the rate applicable on the date of invoice.

Sample material may not be from the same batch as the installation product and therefore exact colour match cannot be agreed. Any information and technical advice given by the company, whether verbal or written is for guidance only and is submitted in good faith. Placing an order with Top Floors implies acceptance of the company’s trading terms and conditions.

Any delays to the installation schedule that are caused by the site being left unfit for commencement of floor fitting will result in additional costs. Appointment times are an indication of a time and not an exact time. We cannot be held responsible for not meeting the indicated time exactly or any costs associated to this.

If the material you have chosen is no longer available, we will advise you to choose different flooring. If a quotation is provided on plans only, it is for guidance and subject to change once works commence and all rooms are measured by Top Floors. Changes to the quotation required after commencement of work will be discussed with you and appropriate changes to the quote will be made or the works will be placed on hold until such agreement on the works are met.
